APPROVAL PROCEDURES AND DOCUMENTATION FOR OBTAINING

MINING PERMITS IN OPEN AREAS

Pursuant to Article 100 of the Constitution and article 29, paragraphs 1 and 11, 30 and 56, paragraph 1, of Law No. 10 304, dated 15.07.2010 “On the mining sector in the Republic of Albania”, the proposal of the Deputy of the Minister of Economy, Trade and Energy, the Council of Ministers

DECIDED:

1. In an application for mining permits in the open areas, the surface area required shall be

located within the areas to open areas published as annual mining plan.

2. Complete documentation of the application for a mining permit submitted to the National Center

Licensing (QKL) and the application date announced by the center.

3.QKL electronically forwards the Ministry of Economy, Trade and Energy full documentation of the mining license application and enables access to this documentation to review institutions, the National Agency of Natural Resources (AKBN) and Albanian Geological Survey (SHGJSH).

4. Evaluation of conditions permitting and review of documents corroborating the requirements the prospecting mining license groups metallic minerals, non-metallic, coal and bitumen; for the mineral construction and radioactive minerals group, carried out by Albanian Geological Survey (SHGJSH), and requirements;
5. For mineral permits for groups of metallic minerals, non-metallic, coal and bitumen; for the mineral construction; for group of radioactive minerals and exploration permits for the group-exploitation of minerals precious and semi-precious, conducted by the National Agency of Natural Resources (AKBN).
6. Drafting the approval of the mining permit is carried by the respective department covering the mining ministry in Albania and then approved by Minister.
7. Review of applications for mining permits for open areas made on the basis of the principle “of first in time, first in right “, and the act of approval of the Minister given entity has applied the first and fulfill the conditions of admission and documentation under section 10 of this decision.
8. The entities applying for a mining permit exploration, exploitation or search/discovery, along with the documentation file for mining permits are required to declare in writing the legal source of all geological information or geological-mining, the documentation used in the construction of the applicant.
9. Application for a mining permit or mining permit use search and discovery/use it prevails over a permit application for the prospecting.
10. Requests submitted, those in process or pending, in the sense of Article 57 of the law No. 10 304, dated 01.07.2010 “On the mining sector in the Republic of Albania” will be called requirements that have conducted environmental permit application and approved by the institution of AKBN project development of mining activities, prior to the entry into force of law above.
11. Detailed conditions and supporting documents to ensure the fulfillment of these conditions to be met by the applicant for a mining permit and treatment procedures requirements with the terms defined as follows:

A.1 application with complete documentation for a mining permit is made to the research and discovery

Full documentation includes:

1. a) An extract of the decision of the National Registration Centre (QKR) for registration as legal person, where the object of the activity have approved the development of the activity surface mining or underground works as required.
2. b) A description of the technical, professional and managerial capabilities of the applicant, which to the applicant for the business of the exploration, including Curriculum Vitae of its staff that will work for this activity, as well as a description of his experience previous in the mining industry, if any.
3. c) Contract with the technical director of works, notarized, which should be engineer mining operations, the scope of exploration under the names of universities, certified by relevant diploma.
4. d) One of the necessary financial resources for the realization of investments programmed for develop mining activities in exploration and / or by verifying the existence thereof, as follows:
5. i) A statement from the bank confirming that a person has opened the account number, where this stored at least 20% of the investment envisaged in the investment program who submitted;
6. ii) A document certifying that a person has obtained a loan from a bank, or another financial entity value, which covers investments foreseen to be committed;

iii) A contract with an investor, which provides financial support for the implementation of investment program. In this case, the legal entity must submit a notarized document in which he expresses the desire of investors to support this investment, as well as documents proving financial resources of the latter (bank guarantee or the economic balance of the company, in which investor is the owner / sole shareholder, or shareholder of majority ownership of shares / primary majority).

1. d) The financial resources necessary for the realization of investments programmed for develop the mining exploitation or exploration-exploitation and certificates for their existence may be as follows:

3. ii) A document certifying that a person has obtained a loan from a bank or other financial entity, securities, which covers investments envisaged to be carried out.

– The estimated production capacity with the escalation of labor operations;

– Proposals on pollution prevention, treatment sterile, protection of natural resources, progressive reclamation and rehabilitation of damaged land caused by mining exploitation and to minimize the effects of mining on surface water, water groundwater and adjacent land areas in the permitted area;

– Effects that may occur on the environment from mining operations and proposals minimize them;

– Any special risk (health or otherwise) that may arise during use minerals and proposals to control and eliminate them.

B.2 AKBN looking verifies mining area and prepares an attestation by the form specified in Annex 4, attached to this decision, performs peer review, technical committee examines project development activities or mineral exploitation exploration-exploitation, the investment program for the use or search zbulimshfrytëzimin, the project of rehabilitation of the mining area and provisions for guarantees values for implementing the investment program and the implementation of the rehabilitation plan of the area mining and to the Ministry of Economy, Trade and Energy no later than 60 (sixty) calendar days after the date of application to the NLC, the decision of approving or not technical council, signed by the institution and the secretary of the council.

B.3 Minister within a period of 120 (one hundred twenty) days from the date of QKL application, issue the act of approval or refusal to permit use, search, exploitation and financial guarantees for the implementation of the minimum work program and the implementation of Rehabilitation plan of the mining area. 11. Acceptance of applications according to the procedures set out in this decision begins after entry in effect the decision of the Council of Ministers for adoption of the 3-year-old mining and annual mining plan.
