APPROVAL OF INFORMATION FORM AND CONTENTS OF MANDATORY PREPARED BY MINING PERMIT HOLDERS

Pursuant to Article 102 paragraph 4 of the Constitution of the Republic of Albania, Article 36, point 23, and Article 56 paragraph 2 of Law No. 10 304, dated 15.07.2010 “On the mining sector in the Republic of Albania”

ORDER:

1. Any holder of a mining permit research and discovery shall prepare and submit to the institution of the Albanian Geological Survey (SHGJSH) required information, according to the format, content and definitions of terms contemplated mining law No. 10 304, dated 15.7 .2010 “On the mining sector in the Republic of Albania” and bylaws for its implementation.

This information is required are:

1. a) Document the financial guarantee for the implementation of the minimum work program no later than 30 (thirty) days from the date that corresponds to the effective date of the permit;
2. b) The statement of the financial guarantee for the implementation of the plan of environmental remediation of the mining area that appear each year, not later than 30 (thirty) days from the date that corresponds to the effective date of the permit, for each subsequent year;
3. c) Information 3 (quarterly) on realization of investments, mining conducted and all operations carried out for the environmental rehabilitation and management of mining waste, in accordance with its obligations to the mining permit and plan, not later than the date 15 of the following month for each quarter;
4. d) Annual information on financial activity and technical analysis and all operations carried out in accordance with the obligations stipulated in his permit and annual work plan, including the measures taken to protect the health and safety at work, training of employees, not later than 30 (thirty) days from the end of the relevant year;
5. e) Annual assessment of the value of the guarantee for implementing the minimum work and financial guarantee for the implementation of the plan of environmental remediation of the mining area, which is presented annually, no later than 30 (thirty) days from the date the corresponding to the entry into force of the license for each subsequent year for approval;
6. f) The final report for the development of the mining activity in detail given the investments made during the search-discovery, the work performed in his permitted area (coupled with engineering drawings) and the results of all evidence obtained;
7. g) Report on payments to local and national taxes, under the initiative for transparency in the extractive industry;
8. h) The information on storage, handling and management of mining waste and waste water arising from mining facilities and waste disposal;
9. i) Information on licenses, authorizations or permits, obtained by the holder of the permit if the performance of its activity, action or use of a public good in the permitted area, which, according to the permit is not part of the rights the holder of the mining permit, require prior approval from state authorities;
10. j) Hold the society offices available for inspection by SHGJSH Union and to provide information and explanations when requested by the institution.
11. Each holder of a mining permit exploitation and / or exploration-exploitation shall prepare and submit to the institution of the National Agency of Natural Resources (AKBN) required information, according to the format, content and definitions of terms provided in law No.10 mining 304, dated 15.07.2010 “On the mining sector in the Republic of Albania” and the regulations adopted pursuant to it. This information is required are:
12. a) Document the financial guarantee for the implementation of the investment program, no later than 30 (thirty) days from the date that corresponds to the effective date of the permit;
13. b) The statement of the financial guarantee for the implementation of environmental rehabilitation plan of the mining area that appear each year, not later than 30 (thirty) days from the date that corresponds to the entry into force of the license for each subsequent year;
14. c) Information on payment of royalty, by type of mining permit, the deadlines set out in legislation on taxes;
15. d) Information 3 (quarterly) on realization of investments, mining conducted and all operations carried out for the environmental rehabilitation and management of mining waste, in accordance with its obligations to the mining permit and plan, not later than the date 15 of the following month for each quarter;
16. e) Annual information on financial activity and technical analysis and all operations carried out in accordance with the obligations stipulated in his permit and annual work plan, including the measures taken to protect the health and safety at work, training of the employees, not later than 30 (thirty) days from the end of the relevant year;
17. f) Annual assessment of the value of the guarantee for implementation of the investment plan and financial guarantee for the implementation of the plan of environmental remediation of the mining area that appear each year, not later than 30 (thirty) days from the date the corresponding entry applicable permit for each subsequent year for approval;
18. g) The final report for the development of mining activities, giving in detail the investments made during the mining activity, the works carried out in his area permit (accompanied by engineering drawings) and the results of the closure plan, the rehabilitation plan, the plan waste management and monitoring post-mining plan;
19. h) Report on payments to local and national taxes, under the initiative for transparency in the extractive industry;
20. i) Information on storage, handling and management of mining waste and waste water arising from mining facilities and waste disposal;
21. j) Information on licenses, authorizations or permits, obtained by the holder of the permit if the performance of its activity, action or use of a public good in the permitted area, which, according to the permit is not part of the rights the holder of the mining permit, require prior approval from state authorities;
22. k) Keep the organization’s offices available for inspection by SHGJSH Union and to provide information and explanations when requested by the institution.

This order comes into force immediately.
