ON APPROVING THE FORM AND CONTENTS OF ACTIVITIES PLAN FOR CLOSURE A MINING ACTIVITIES

ON APPROVING THE FORM AND CONTENTS OF ACTIVITIES PLAN FOR CLOSURE A mining activities
Pursuant to Article 102 paragraph 4 of the Constitution of the Republic of Albania, Article 53, section 7 and section 56, paragraph 2 of Law No. 10 304, dated 15.07.2010 “On the mining sector in the Republic of Albania”
ORDER:
- Plan for the closure of mining activity is part of the rehabilitation plan of the mining area, as his special chapter includes the entirety of the documentation and technical, economic and environmental.
- Plan for the closure of mining activities prepared by the applicant for obtaining a mining permit and drafted by natural or legal persons licensed in the field of research activities in the mining project. The plan drawn up in accordance with the basic principles for drafting the rehabilitation of the mining activity that rely on mining and environmental legislation in force, as well as international best practices and presented the documentation for obtaining the mineral rights.
- Plan for the closure of the mining activity of an abandoned mine, used by the former state-owned enterprises, or a mining facility the prospecting wells drilling conducted by the state, drawn up by the responsible structures, Albanian Geological Survey (SHGJSH) to exploration areas and the National Agency of Natural Resources (AKBN) for use areas.
- All of abandoned mines that are considered as such, under the provisions of Law No. 10 304, dated 15.07.2010 “On the mining sector in the Republic of Albania”, go to closing and monitoring post-mining regime after evaluation studies National Agency Natural Resources (AKBN) and together with financial costs for the shutdown, which are covered by the state budget approved by the Council of Ministers.
- AKBN proposes the closure of mining areas for mining activities, according to a plan for the closure of mining activity. This plan must argue and justify the closure of mining activity and should include the actions required by the deadlines, ensuring financing for effective measures for closing the mine, according to the requirements of mining and environmental legislation in force,
- All mines abandoned by holders of mining permits, spend on post-mining regime following the closure and monitoring assessment studies of the National Agency of Natural Resources (AKBN) and approved by the Council of Ministers. The financial guarantee for environmental rehabilitation used for the realization of this plan.
- Plan for the closure of mining activities for mining permit areas abandoned by the holder of a mining permit and mines used by the state implemented by specialized state entities, or private, selected according to procurement procedures, in accordance with applicable law, controlled and monitored by AGS Union for exploration areas and areas AKBN exploitation and exploration-exploitation.
- Procedures for the closure of mining activities of a mining building done according to plan for the closure of mining activities approved, pursuant to the provisions of Article 53 of Law No. 10 304, dated 15.07.2010 “On the mining sector in the Republic of Albania” .
- Plan for the closure of mining activities should be based on the principles of:
- a) Ensuring the elimination of the harmful effects of mining operations on community health and life of the mining areas in the future for a much longer period;
- b) Ensuring the elimination of mining activity harmful effects of pollution on land, on water, flora and fauna and the ecosystem in general discharges and emissions in the future for a period as long as and respect standards minimum, approved by the legislation on mining activity and the environment;
- c) Closure progressive mining activities by eliminating the effects of this activity during the mining permit;
- d) Ensuring the safe closure of mining activities;
- e) Ensuring the safe demolition of the buildings of the mining activity, which can not be used further after the completion of this activity, as defined in applicable legislation;
- f) The implementation of the completion of the process of closure of mining the former state-owned mining;
- g) Cooperation and joint actions between the authorities of central and local government;
- h) Coordination between environmental protection and economic development.
- Plan for the closure of mining activity should include:
- a) Project termination of mining activities to be carried out, taking into account:
- i) general description of the territory, flora and fauna;
- ii) description of the building exploit mining, pun capital tion and ancillary surface facilities, processing and recycling plants and waste disposal square, used reserves or remaining;
iii) mining waste composition and physico-chemical characteristics thereof;
- iv) the movement of surface and underground waters;
- v) infrastructure and the proximity to residential areas;
- vi) the impact of mining facility closed in the life and health of the community of the mining area;
vii) the impact on the ecosystem of the mining area and the surrounding;
viii) the impact on the ecosystem in general;
- ix) the level of emissions into the environment and causing pollution to surface and underground waters, flora and fauna, in future mining facility after closure;
- x) treatment in the future after the closure of the waters of the gases that arise from mining;
- xi) protective columns that are part of the resource / mineral reserves or the surrounding rocks, which are not used for the protection of underground and surface mining area;
xii) the way of protecting the embankments of rivers or other surface and engage in dangerous area of a mining right.
- b) forecast for the procedures and deadlines realizing the mine closure process, career, processing plants, recycling plants and the storage site.
- c) the progressive realization of the process of termination of mining activities, as it is stipulated in the project of development of mining activities.
- d) possibilities of accidents and risk of mining facility after closing.
- e) for mining residues which result from processes which use toxic and dangerous, such as cyanide, acids, chemicals dangerous plan of termination of mining activities must also include and eliminate these toxic and dangerous.
- Information documents held by the relevant structures or entities selected for implementation of the plan for closure of mining activities should be consistent with the requirements of mining and environmental legislation in force and shall include also:
- a) lot plan works facility, closure allowed the mining area and the square mineral deposit of sterols, according to the approved project;
- b) lot plan works, closure plan for processing and recycling plant;
- Form and content type of “plan for closure of mining activity” for exploration permits will be in accordance with Annex 1 of this order.
- Form and content type of “plan for closure of mining activity” for revoking the permits and permits exploration-exploitation will be under Annex 2, attached to this Order.
- To carry out the order of the institutions charged the National Agency of Natural Resources (AKBN), Albanian Geological Survey (SHGJSH) and the National Licensing Centre (QKL).
This order comes into force immediately.
