APPROVAL OF THE REGISTRATION PROCEDURES AND DOCUMENTATION TO REGISTER IN CADASTRE MINING AND MINING REGISTRY, AND FORM AND REPORTING PROCEDURES OF THIS DOCUMENTATION BY HOLDERS OF MINING PERMITS

Pursuant to Article 102, paragraph 4 of the Constitution of the Republic of Albania, Article 44, paragraph 2 and article 56, paragraph 2 of Law No. 10 304, dated 15.07.2010 “On the mining sector in the Republic of Albania”

ORDER:

1. Register mining includes all information on the legal regime of surface mining areas and neighboring areas, ownership, topographical situation of mining areas of work supporting mining activities, reserves and mineral production, as well as data on the holder mining permits, as follows:
2. Data on the legal regime of surface mining areas and neighboring areas:
3. a) Mining area with no identification number, which is approved mining permit and mining included in the annual plan approved for the year and the licensed mining permit no.,date … / /
4. b) Type of mineral / minerals, for which the permit is granted:
5. c) Allowing the surface area of ​​the mining permit in km2:
6. d) Map of the area allowed the mining permit in the state coordinates plans, its legal regime under the verification of the relevant structure (an original copy of it).
7. e) Map of the area allowed the mining permit in the state coordinates plans, approved by the structure of the council responsible by technical decision (a copy of its original).

7. a) Name of mining entity that holds the mining permit by registering in the QKR:

(a copy of the extract QKR society at the time of issuing the permit, which must be updated to reflect the changes in this extract long-term mining permit at the end of this term).

1. b) Name / names of the owners of the mining company, owner of the mining permit, according to their percentages in the company according to the census in the QKR: (percentages of the shareholders in the company at the time of issuing the permit, which must be updated to reflect the changes in this extract long-term mining permit at the end of this term). 10. ii) to manufacture mineral reserves submitted by the holder of the permit at the time of application for a mining permit and deposited with the National Licensing Centre (QKL).
11. Data on the holder of the mining license after the act of approval of the Minister, sent to the institution of QKL, the department responsible for mining activities METE held within this institution.
12. The data included in the mining registry dealing with the legal regime of surface mining areas and neighboring areas, property, valued in the act of verification and Technical Council decision by the Albanian Geological Survey (SHGJSH) for the areas of search and Intelligence and National Agency of Natural Resources (AKBN) for areas of exploitation and exploration-exploitation, and sent to QKL.
13. METE Directorate responsible for mining operations, Albanian Geological Survey (SHGJSH) and the National Agency of Natural Resources (AKBN) have the right to dispose online information related to the scope of work of their operations.
14. Register for any mining mining also includes data for administrative offenses and the holder of a mining permit and mining permit status, suspension or revocation proceedings.
15. In the mining registry includes also all mining areas that have been closed or are in the process of closing or conservation.
16. Institution of QKL holds the mining registry, linking all data to a mining area with the data mining permit holders and conducts the administration of these data structures responsible mining activities under the laws of operation this center.
17. Changes to the holder of the mining permit realized from the transfer of a permit, must be reflected in the mining registry within a period of not more than thirty (30) calendar days from the date of the act of tr ansferimit.
18. Changes to the administrator and technical executives realized in the National Registration Centre (QKR) by the entity reflected in the mining and mineral extract subject to QKR, they should be reflected automatically by QKL in the mining registry.
19. Mining cadastre includes systematic inventory of data on immovable property, support mining activities, land, buildings and installations of the surface or underground, in terms of technical, economic and other data for the permitted mining areas as follows:

21. a) agricultural land with the level of fertility;
22. b) land of forest and pasture fund;
23. c) land owned by local authorities;
24. d) state land;
25. e) private land;
26. f) land owned entity of a mining permit holder.
27. Data on immovable property of the holder of the mining permit:
28. a) Basic works, auxiliary and exploitation, development of underground mining activity or career.
29. b) Surface, as roadway for the opening and operation of the facility mining columns wells, annexes, offices, showers and toilets, wardrobe, dormitory, canteen, warehouse materials, the hall compressor, electrical cabinets, pumping station, workshops, warehouse explosive material and other facilities.

37. Data on existing real estate in the area allowed the mining permit:
38. a) Basic works, ancillary exploitation, mining carried out in the premises of the former state-owned mining enterprises or former holder of a mining permit for the mining facility.
39. b) Surface built facility mining of former state owned enterprises or holders of previous mining permit for that facility mining as roadway for the opening and operation of the facility mining columns wells, annexes, offices, showers and toilets, wardrobe, dormitory, canteen, warehouse materials, compressor room, electrical cabinets, pumping station, workshops, warehouses and explosive materials and other facilities.
40. c) Land of the permitted area owned mining permit state and / or local authorities and / or private and / or offset.
41. d) Machinery and equipment of underground or surface used for the development of mining activities, which have been owned by the former state-owned mining enterprises.
42. e) mineral processing plants, recycling plants and waste, equipment for monitoring of mining activities and mining risk, dumps or structure built for landfills that have been owned by the former state-owned mining enterprises.
43. f) the financial value of real estate, valued at the time of registration.
44. Information on other real estate carried out by the holder of a mining permit in the context of mining activity, but not related to this activity that may or may not be owned by the holder of the mining permit:
45. a) socio-cultural facilities, education, health facilities for community protection of the mining area.
46. b) infrastructure facilities such as roads, etc., to serve the community of the mining area.
47. The data relating to real estate created by the holder of a mining permit to engage in mining cadastre register in cadastre the request of the holder of the mining permit certifying their ownership in accordance with the requirements of legislation on ownership property.
48. The data included in the mining cadastre and dealing with real estate created by former state mining enterprises registered in mining cadastre estimates after mining institutions and presentation of these estimates in the QKL, where their registration for any mining or mineral subject area.
49. Data on the ownership of land taken by the relevant institutions of the ownership certificate and registered in the mining cadastre by QKL, where their registration for each object mining or mining area.
50. Institution QKL holds mining cadastre, linking all data to a data mining area of ​​real estate, land ownership of the area mining and realizes the management of these data structures in charge of the mining activity according to the laws of the functioning of the center.
51. Both documents registry cadastre mining and mining related to each other through the mining area which is the first element of identification of two registers.
52. Records are recorded electronically in the institution of QKL. The level of confidentiality of data carried out in respect of the requirements of the mining legislation and Albanian legislation.
53. To carry out the order of the institutions charged QKL, QKR, SHGJSH, the AKBN and METE directorate responsible in addressing the problems of mining permits.

This order comes into force immediately.
