ON APPROVING THE FORM AND CONTENTS OF THE CONSERVATION PROJECT mine

Pursuant to Article 102, paragraph 4 of the Constitution of the Republic of Albania, Article 55, paragraph 8 and article 56, paragraph 2 of Law No. 10 304, dated 15.07.2010 “On the mining sector in the Republic of Albania”

ORDER:

1. All mines abandoned by the provisions of Law No. 10 304, dated 15.07.2010 “On the mining sector in the Republic of Albania”, considered as such, go to conservation and monitoring post-mining regime after evaluation studies National Agency Natural Resources (AKBN) and approval by the Council of Ministers.
2. AKBN proposes the mining license areas for conservation, according to a conservation project. This conservation project developed for mining facilities where:
3. a) mines are still used by the state geological reserves and exploitation process can proceed by the interested parties;
4. b) the continuation of exploitation become ineligible for economic reasons;
5. c) the holder of a mining permit for the mining abandoned his reasons, while the activity of mineral exploitation in this object can have economic benefits;
6. d) due to geological-mining natural or become ineligible to continue operating and to be guaranteed a new way of exploitation of mining facility.
7. The conservation project for the mining permit areas abandoned mines specialized subjects implemented by governmental or private, selected according to procurement procedures, in accordance with the legislation in force.
8. Control of the conservation project implementation is carried out by AKBN.
9. Procedures conservation a mining abandoned object, made by conservation project approved, pursuant to the provisions of Article 55 of Law No. 10 304, dated 15.07.2010 “On the mining sector in the Republic of Albania”.
10. conservation project should be based on the principles of:
11. a) protection and conservation works on the object mining and mineral reserves as unique resources.
12. b) receipt of preventive and protective measures for the life and health of the communities in the area, pollution in soil, waters, flora and fauna, environment and ecosystem in general, as well as infrastructure.
13. c) Consultation with local government authorities.
14. d) Coordination between environmental protection and economic development.
15. The project of conservation of an abandoned mine, compiled by the National Agency of Natural Resources (AKBN) and approved by the Minister.
16. Form and content type of the project of conservation of the mining facility will be under Annex 1 of this order.
17. For the implementation of this order charged the institution of the National Agency of Natural Resources (AKBN).

This order comes into force immediately.
