ON APPROVING THE FORM AND CONTENTS OF PLAN MONITORING post-mining
Pursuant to Article 102, paragraph 4 of the Constitution of the Republic of Albania, Article 54, paragraph 6 and article 56, paragraph 2 of Law No. 10 304, dated 15.07.2010 “On the mining sector in the Republic of Albania”
ORDER:
- The monitoring plan is part of the post-mining rehabilitation plan of the mining area, as his special chapter. Post-mining monitoring plan prepared by the applicant for obtaining a mining permit and drafted by natural or legal persons licensed in the field of research activities in the mining project. The plan drawn up in accordance with the basic principles for drafting the rehabilitation of the mining activity that rely on mining and environmental legislation in force.
- The monitoring plan post-mining of an abandoned mine, used by the former state-owned enterprises, or the prospecting mining facility with drilling wells, conducted by the state, drawn up by the responsible structures, Albanian Geological Survey (SHGJSH) for areas exploration and the National Agency of Natural Resources (AKBN) permits mining and exploration-exploitation.
- Monitoring Plan permits post-mining areas of mining and abandoned mines used by the state implemented by specialized state entities: SHGJSH Union for exploration permits and permits AKBN exploitation and exploration-exploitation, or private, selected according to procurement procedures, in accordance with the legislation in force by the said and monitored by it.
- Control of monitoring the implementation of the post-mining plan carried out by SHGJSH Union for exploration permits and permits AKBN exploitation and exploration-exploitation.
- Monitoring procedures post-mining a mining facility, which is closed or ended mining operations are realized according to the plan approved post-mining monitoring, pursuant to the provisions of Article 54 of Law No. 10 304, dated 07.15.2010 “On the mining sector in the Republic of Albania “.
- post-mining monitoring plan should be based on the principles of:
- a) continuous monitoring of pollution on land, in water, the flora and fauna and the ecosystem in general, and to respect the minimum standards adopted by legislation.
- b) Determining the exact points of monitoring emissions and discharges of harmful environmental elements during operation and in the future.
- c) Set up monitoring equipment according to the characteristics of the emission, composition, decomposition time by new technologies and best practices.
- d) Setting monitoring points that will serve the information for determining early preventative measures.
- e) Ensuring the monitoring of the effects of waste in the future for a much longer period.
- f) Consultation with local government authorities.
- g) Coordination between environmental protection and economic development.
- post-mining monitoring plan is updated according to deadlines set by environmental legislation in force and shall contain:
- a) post-mining project monitoring to be carried out taking into account:
- i) general description of the territory, flora and fauna;
- ii) the square of waste disposal;
iii) mining waste composition and physico-chemical characteristics thereof;
- iv) The movement of surface and underground waters;
- v) infrastructure and the proximity to residential areas;
- vi) the impact on the ecosystem of the mining area and the surrounding;
vii) the impact on the ecosystem in general;
viii) the level of emissions into the environment and causing pollution to surface and underground waters of flora and fauna.
- b) forecast for the places and the time for monitoring of emissions after the mine closure process, career, recycling plants and the storage site.
- c) procedures and time limits for implementation of works establishment of monitoring points;
- d) monitoring procedures for emergency cases for accidental pollution.
- e) for mining residues which result from processes which use toxic and hazardous substances such as cyanide, acids, dangerous chemical substances, post-mining monitoring plan should also include:
- i) monitoring the level of concentration of toxic or hazardous elements in waste disposal or discharges from mining, in respect of the requirements specified in environmental legislation;
- ii) continuous monitoring mode on time, respect the requirements specified in the environmental legislation.
- Documents information held by the relevant structures or entities selected for monitoring the implementation of post-mining, should comply with the requirements of the mining legislation and the effective and advantageous geogra ment should include also:
- a) lot plan copy of the monitoring points for allowing mining area and the square of the sterile deposit, according to the approved project.
- b) lot plan copy of the monitoring points for the recycling plant.
- c) statements for monitoring by deadlines set about the physical and chemical composition of discharges to the environment for all monitoring points, coupled with sheet-related analysis.
- Form and content type of “post-mining monitoring plan” for exploration permits will be in accordance with Annex 1 of this order.
- Form and content type of “post-mining monitoring plan” for revoking the permits and permits exploration-exploitation will be under Annex 2, attached to this Order.
- According to the current level of volatility observed and determined in the field and that expected due to the change in time of various parameters associated with, dangerous areas can be classified under Annex 3 attached to this order.
- To carry out the order of the institutions charged the National Agency of Natural Resources (AKBN) and Albanian Geological Survey (AGS).
This order comes into force immediately.

CLASSIFICATION OF DANGEROUS AREAS
